Trusted Advice And Representation In All Aspects Of Maryland Divorce

At Thomas Sims Law Firm, we provide experienced representation to clients in all aspects of divorce, including property division, alimony, child custody, child support and more. On this page, we will focus primarily on the financial and logistical aspects of divorce, such as property division and alimony.

How Will Your Property Be Divided In Divorce?

Like most other states, Maryland uses the “equitable distribution” model of asset division. This means that courts are instructed to divide marital assets equitably between spouses, which doesn’t necessarily mean a 50-50 split. However, judges can award one spouse a larger share of the marital estate based on a number of considerations, so long as the division was equitable.

When you work with us, we will take the time to learn which assets are most important to you and prioritize them during negotiations or litigation. Common big-ticket items include the marital residence and other real estate, retirement accounts (in either spouse’s name), vehicles and valuable personal collections.

The Role Of Alimony In Maryland Divorce

Alimony, sometimes called spousal support, used to be standard in most divorces. This has changed in recent decades as men and women now participate in the workforce at similar rates. Nonetheless, in cases where it is appropriate (for spouses regardless of gender), courts can award alimony pendente lite (which applies while the divorce is pending) and/or post-divorce alimony.

If you believe alimony should be awarded as part of your divorce, we can help you negotiate an agreement with your spouse or petition the court. Similarly, if your spouse is seeking alimony and you don’t believe it is necessary or fair, we can ask the court to deny the order.

Help For Small-Business Owners And Others With Complex Assets

If you own a business, divorce could pose a great risk to its future. Even if your spouse has no part in the daily operations of your business, chances are good that they nonetheless have a financial stake that could be nearly equal to yours. Therefore, you’ll need to work with an attorney – like those at our firm – who understands how to protect your business and secure your full ownership of it.

Additionally, our lawyers have the knowledge and experience to guide clients with significant and complex assets through the property division process. These could include investment portfolios, commercial real estate, valuable artworks, vacation homes and more.

Representation For Military Service Members Or Spouses

There is no separate legal process for getting divorced if you or your spouse is in the military. But military service does pose additional logistical challenges related to residency requirements, deployment, military pensions and more. We are proud to represent clients who serve or have spouses who serve, and we offer experienced guidance through the unique aspects of military divorce.
